1. Introduction

Welcome to In-2-Gigs™ ("Platform"). This document combines our Terms & Conditions and Privacy Policy. By accessing or using In-2-Gigs™, you agree to comply with and be bound by these Terms and Policies. If you do not agree, please refrain from using our services.

2. Definitions

  • User: Any individual or entity accessing or using the Platform, including Freelancers and Project Creators.
  • Freelancer: A User offering services through the Platform.
  • Project Creator: A User seeking services through the Platform.
  • Services: The freelancing services offered by Freelancers and the related functionalities provided by the Platform.

3. Eligibility

  • Users must be at least 18 years old to register and use In-2-Gigs™.
  • Users from countries or regions subject to international sanctions or legal restrictions are prohibited from using In-2-Gigs™. Users are responsible for ensuring compliance with local laws.

4. Account Registration

  • Users must provide accurate, complete, and updated registration information.
  • Users are responsible for maintaining the confidentiality of their account login details and all activities under their account.
  • By registering, Users consent to receive communications from In-2-Gigs™ via email.

5. Services Offered

  • In-2-Gigs™ serves as a marketplace connecting Freelancers and Project Creators. The Platform does not endorse or guarantee the quality of services offered.
  • Users are solely responsible for the content they post, including job listings and profiles, and must ensure that such content does not violate any laws or third-party rights.

6. Payments and Fees

  • All payments are processed securely through third-party payment gateways: Stitch, PayPal, and Paystack.
  • For transactions via Paystack (South Africa), the Platform fee is 2.9% of the transaction amount, plus ZAR 1, with 15% VAT applied to that fee. Other gateways may charge different rates; users will see the applicable fee before confirming payment.
  • In-2-Gigs™ applies a tiered service fee as follows:
    • 10% for project values under ZAR 750
    • 15% for project values between ZAR 750 – ZAR 7,500
    • 20% for project values above ZAR 7,500
  • Freelancer payouts occur weekly after payment is received and Project Creator approval is granted.
  • Default currency is USD, with real-time ZAR conversion available. Currency conversion fees may apply and are the responsibility of the user.
  • Gateway fees are not part of In-2-Gigs™ commissions and may be passed to Freelancers or Project Creators depending on transaction terms.
  • Refunds are subject to platform and gateway fee deductions. See our Refund Policy for details.
  • In-2-Gigs™ reserves the right to adjust any fees or percentages. Changes will be communicated via email and posted on the Platform. Continued use constitutes acceptance.

7. User Conduct

  • Do not violate any laws or regulations.
  • Do not infringe on the rights of others.
  • Do not post false, misleading, or fraudulent content.
  • Do not transmit malware or engage in hacking.
  • Do not solicit or spam other Users.

8. Dispute Resolution

  • Users are encouraged to resolve disputes directly through the Platform's messaging system.
  • If disputes remain unresolved, In-2-Gigs™ may offer mediation but is not obligated to intervene or settle disputes.

9. Intellectual Property

  • Users retain rights to the content they upload but grant In-2-Gigs™ a non-exclusive, worldwide, royalty-free license to use such content for operational purposes.
  • All content on the Platform, excluding user-generated content, is the property of In-2-Gigs™ or its licensors and is protected by intellectual property laws.

10. Termination

  • In-2-Gigs™ may suspend or terminate accounts that violate these Terms or pose a risk to the integrity or security of the Platform.
  • Users may delete their accounts by contacting support@in2gigs.co.za.

11. Privacy Policy

Information We Collect

  • Account & Profile Info: Name, email, phone, company, skills, expertise
  • Project Info: Project Title, Description, Amount, Project ID
  • Payment Data: Transaction amount, fees, payment intent, Stitch/PayPal/Paystack IDs
  • Usage Data: IP address, form interactions, URL parameters
  • Technical & Session Data: Browser, device, timestamps, cookies

How We Collect It

  • Directly via platform forms submitted by Freelancers and Project Creators
  • Technical capture using URL parameters and hidden fields (e.g., IP address)
  • Payment integration via Stitch, PayPal, and Paystack APIs on-site
  • Platform/database synchronization for Freelancer onboarding and project tracking

How We Use Your Information

  • To provide the platform: match Freelancers with suitable projects
  • To process payments: calculate commissions, process transactions, release funds
  • To improve the platform: debug flows, enhance customer service, prevent fraud
  • Marketing (optional): with your consent only, for notifications or updates

Who We Share Data With

  • Third-party services: Stitch, PayPal, Paystack — for payment processing
  • Platform tools: CRM systems, email providers, analytics tools
  • Legal requests: where required by law or regulation
  • Partners: only with explicit consent (e.g., referral programs)

Data Retention

We retain personal data only as long as necessary to provide services, comply with legal requirements, or resolve disputes. Technical logs (IP, device data) may be stored securely for at least 2 years for auditing and fraud prevention purposes.

Cookies & Tracking

We may use essential, performance, and functionality cookies to enhance user experience. Users can manage cookie preferences via their browser settings.

Security Measures

We implement physical, technical, and organizational safeguards (e.g., HTTPS, encryption, restricted access). While no system is 100% secure, we regularly audit and update our protocols.

International Data Transfers

Data may be processed or stored on servers located outside South Africa by our trusted partners. We ensure these transfers are secure and compliant.

Children’s Privacy

Our platform is not intended for users under 18 years old. We do not knowingly collect personal data from minors.

Updates to Privacy Policy

We may update this policy periodically. Updates will be communicated via email or prominent notice on the platform. Changes take effect upon posting.
